Terms of service

Effective date: October 6, 2026

These terms are an agreement between you and Asynchronous Sports Inc. (“we” or “us”) about your use of the Coach Note app for iPhone and Apple Watch (shown as “CoachNote” on your devices). By using Coach Note, you agree to these terms and to our privacy policy. If you don’t agree, please don’t use Coach Note. Please read “Governing law and disputes” below. It contains an agreement to arbitrate and a waiver of class actions that affect your rights.

Who can use Coach Note

You must be 18 or older to use Coach Note. Coach Note is currently available only to people in the United States. You promise that the information you give us is accurate.

To record sessions, you need an iPhone and an Apple Watch paired with it.

Coach Note is in beta

Coach Note is in beta. We’re letting players in gradually, and features may change, stop working or be removed while we build it.

The beta is free. We may reset or delete beta data, and we may end the beta or your access at any time, so keep copies of anything you can’t lose.

If you give us ideas, comments or suggestions, you let us use them freely, without payment or credit to you, to improve Coach Note and our business. Please keep unreleased features and beta builds confidential until we say you can share them.

Your account

You sign in with Apple or with Google. You’re responsible for what happens on your account, so keep your devices secure, and tell us at support@coachnote.app if you think someone else is using it. Don’t share your account or use someone else’s. You can delete your account in the app at any time. Our support page shows how.

Recording other people

Coach Note records audio on court, which can include your coach and other people nearby. Before you record, tell the people who might be recorded and make sure they’re okay with it. You’re responsible for following the recording and privacy laws where you play. Some states, such as California, Florida, Illinois, Pennsylvania and Washington, require everyone in a conversation to agree to a recording.

Each time you start a session, you confirm that the people being recorded know about it and agree. The watch shows that it’s recording, and you can stop at any time.

Get a parent or guardian’s permission before you record anyone under 18. Don’t record anywhere people reasonably expect privacy, such as locker rooms or restrooms.

Your content

You own your recordings and everything you add to Coach Note. Other people’s voices in a recording remain theirs, and you promise you have the right to give us the permission below.

You give us permission to store, process and display your content so we can run Coach Note for you, to show your username and profile photo to other players and your posts to the audience you pick, and to use your content as our privacy policy describes, including for “Help improve CoachNote” while that setting is on. Our privacy policy explains what other people can see. This permission ends when you delete your account, except for what our privacy policy says we keep.

Rules for using Coach Note

Please don’t:

  • record people who haven’t agreed to be recorded;
  • post anything illegal, hateful or harassing, or any photos, videos or other content you don’t have the right to share;
  • try to get into other people’s accounts or data;
  • disrupt or overload Coach Note, or get around its limits or security;
  • copy, sell or reverse engineer the app, except where the law allows it;
  • scrape Coach Note or use anything you get from it to build a competing product or model.

We may suspend or close accounts that break these rules.

Reporting and blocking

You can block other players in Settings, under Support and safety. You can also report a problem to us from Settings or at support@coachnote.app. We may remove content and suspend accounts that break these rules or our Community guidelines.

Health and safety

Coach Note is a training tool. It isn’t a medical device and doesn’t give medical advice. Heart rate, intensity, shot counts and other results are estimates and can be wrong. Talk to a doctor before you start a new training program or if you have a health concern, and stop if you feel unwell. Coach notes are written by AI and can be wrong. They aren’t medical advice or professional coaching, so use your own judgment. Playing sport carries a risk of injury. You take part at your own risk, and you’re responsible for deciding whether an activity is safe for you.

Apple, Google and other services

Coach Note works with services from other companies, like Sign in with Apple, Sign in with Google and Apple Health. Their own terms apply when you use them. Our privacy policy lists the companies that help us run Coach Note.

Apple isn’t a party to these terms and isn’t responsible for Coach Note or for support, maintenance or warranty claims. Apple may enforce these terms against you as a third-party beneficiary.

Changes to Coach Note and these terms

We may change Coach Note or these terms. When we change these terms, we’ll post the new version on this page and update the effective date. If a change is important, we’ll tell you in the app or by email at least 30 days before it takes effect, unless we need to make it sooner for legal or security reasons. If you keep using Coach Note after that, you accept the new terms.

You can stop using Coach Note and delete your account at any time. We may suspend or end your access if you break these terms, or if we stop offering Coach Note.

Disclaimers

Coach Note is provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will always work, be accurate or be available. Some places don’t allow these disclaimers, so they may not apply to you.

Limits on our liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. These limits don’t apply to liability that the law doesn’t let us limit, such as for fraud or willful misconduct. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.

Governing law and disputes

Governing law. These terms, and any dispute between you and us, are governed by Delaware law and, for arbitration, the Federal Arbitration Act, without regard to conflict-of-law rules.

Talk to us first. Before starting a formal dispute, email support@coachnote.app with a description of the problem and what you want. We’ll try to work it out with you within 60 days.

Arbitration. If we can’t work it out, you and we agree to resolve any dispute about these terms or Coach Note through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court. Either of us can bring an individual claim in small claims court, and either of us can ask a court to stop the misuse or infringement of intellectual property. The arbitration will be held by video, phone or in writing unless you ask to attend in person, in which case it will be held in a place reasonably near where you live. We’ll pay the filing and arbitrator fees that the AAA rules require a business to pay.

No class actions. You and we may bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective or representative action. If this waiver is found unenforceable for a claim, that claim will go to court and not to arbitration.

Opting out. You can opt out of arbitration and the class action waiver within 30 days after you first accept these terms by emailing support@coachnote.app with the subject “Arbitration opt-out”. Opting out doesn’t change any other part of these terms.

Courts. If a dispute is brought in court instead of arbitration, as the exceptions above allow, each of us waives any right to a jury trial.

General terms

These terms and our privacy policy are the whole agreement between you and us about Coach Note. If a part of these terms can’t be enforced, the rest stays in effect. If we don’t enforce a right, we haven’t given it up. You can’t transfer your rights under these terms. We can transfer ours as part of a merger, financing, acquisition or sale of our business.
